I admit that I live in Canada. But I went to school in New York. I can recall reading the US Constitution. So, when Mr. Trump said last week that he was going to impose a tariff on steel and aluminum imports, I was puzzled.
I just looked.
Section 8 reads: “1: The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States …”
So … while Mr. Trump might request Congress to impose an import duty, he can’t order one.
Or has he overruled the Constitution?
